PHOTO BOOTH TERMS & CONDITIONS

By requesting a quote, confirming a booking, or engaging the services of Canapés and Confetti (“we”, “us”, “our”), the client (“you”) agrees to the following Terms & Conditions.

1. QUOTES

• All quotes are valid for 7 days from the date issued unless otherwise stated.

• Quotes are subject to availability and do not constitute a confirmed booking.

• Prices are based on the information provided at the time of quoting. Any changes to event details (including date, time, duration, location, access, or inclusions) may result in a revised quote.

• Additional services, add-ons, extended hire time, travel, parking, venue access fees, or staffing requirements may incur additional charges.

• We reserve the right to correct any pricing or typographical errors prior to booking confirmation.

• All prices are in NZD and include GST unless otherwise stated.

2. BOOKINGS & PAYMENT

• A booking is confirmed only once the quote is accepted in writing and the required deposit (if applicable) has been received.

• The remaining balance must be paid in full no later than 14 days prior to the event, unless otherwise agreed in writing.

• Failure to pay the balance by the due date may result in cancellation of services without refund.

3. CANCELLATIONS & CHANGES

• Cancellations made more than 14 days prior to the event may receive a refund of payments made, excluding any deposit.

• Cancellations within 14 days of the event are non-refundable.

• Date changes are subject to availability and may incur additional fees.

• We reserve the right to cancel or modify services due to unforeseen circumstances including equipment failure, illness, venue restrictions, or events beyond our control. In such cases, a full refund of payments made will be issued.

4. EVENT ACCESS & SETUP

• The client is responsible for ensuring:

• Adequate space (minimum 2.5m x 2.5m, unless otherwise specified)

• Access to a standard power outlet within reasonable distance

• Safe and clear access for delivery, setup, and pack-down

• Setup and pack-down time is included within the hire period unless otherwise stated.

5. DAMAGE, MISUSE & SAFETY

• The client is responsible for any loss or damage to equipment caused by guests due to misuse, negligence, or deliberate acts.

• Children must be supervised at all times while using the photo booth.

• We reserve the right to suspend or shut down the booth if behaviour is deemed unsafe, abusive, or likely to cause damage. No refund will be provided in such cases.

6. ATTENDANT & OPERATION

• Where an attendant is included, they will assist guests and ensure smooth operation of the booth.

• Where no attendant is included, the client accepts full responsibility for correct and safe use of the equipment.

7. IMAGES, COPYRIGHT & USAGE RIGHTS

• All images captured remain the property of Canapés and Confetti.

• The client and guests are granted personal, non-commercial usage rights.

• Images may be printed, displayed, and shared by guests at their own discretion.

• We are not responsible for how guests choose to pose or share images voluntarily.

8. PRIVACY & PERSONAL INFORMATION

• We collect personal information (such as names, email addresses, and event details) solely for the purpose of providing our services and communicating with clients.

• Personal information is stored securely and will not be sold or shared with third parties except where required to deliver the service (e.g. online gallery hosting) or where required by law.

• Participation in the photo booth is voluntary, and images captured may contain personal information.

9. IMAGE CAPTURE & GUEST CONSENT

• By using the photo booth, guests consent to being photographed and understand that images may be captured, printed, displayed, and shared digitally.

• It is the client’s responsibility to inform guests that a photo booth will be present at the event.

• We are not responsible for obtaining individual consent beyond a guest’s voluntary participation.

10. PROMOTIONAL USE OF CONTENT

• Canapés and Confetti may use selected images and video captured at events for promotional and marketing purposes, including our website, social media, and advertising. 

• If the client or event host does not wish for images to be used for promotional purposes, this must be advised in writing prior to the event.

• We will not intentionally use images that are inappropriate, sensitive, or damaging to an individual’s reputation.

• Reasonable requests for removal of promotional images will be considered and actioned where appropriate.

11. ONLINE GALLERIES & DATA RETENTION

• Online galleries will be delivered within 7–14 days following the event unless otherwise stated.

• Galleries may be hosted for a limited time and may be deleted after the expiry period.

• We do not guarantee long-term storage of images and encourage clients to download content promptly.

12. LIMITATION OF LIABILITY

• We are not liable for:

• Technical malfunctions beyond our control

• Power failures or venue-related issues

• Reduced image quality due to lighting, space constraints, or guest misuse

• Our total liability is limited to the amount paid for the service.

13. FORCE MAJEURE

We shall not be held liable for failure or delay in performance due to circumstances beyond our control, including but not limited to acts of God, severe weather, government restrictions, venue closures, or emergencies.

14. GOVERNING LAW

These Terms & Conditions are governed by the laws of New Zealand.

15. ACCEPTANCE

By requesting a quote, confirming a booking, and/or making payment, the client confirms they have read, understood, and agreed to these Terms & Conditions in full.
